PURCHASE CONDITIONS

1. Scope of Application

These purchase conditions apply to all orders placed with CONTAIN by both private clients and professional clients.

Additional or different conditions may apply to business clients (B2B) and contract projects when expressly agreed in writing.

By placing an order with CONTAIN, the client confirms acceptance of these purchase conditions.

2. Product Characteristics

All CONTAIN products are handmade to order in our workshop in Mallorca.

Variations in colour, texture, finish, veining and dimensions are inherent to the use of natural materials and artisanal manufacturing processes and do not constitute a defect.

Technical drawings, samples, photographs and visual representations are provided for guidance only. Minor deviations resulting from handcrafted production processes or material behaviour are normal and shall not be considered defects.

Custom orders may include, but are not limited to:

• Special finishes

• Non-standard dimensions

• Custom technical specifications

• Project-specific adaptations

3. Natural Materials

Many CONTAIN products incorporate natural materials such as alabaster, stone, brass and glass.

Each piece is unique and may present natural variations in colour, translucency, veining, density, pattern and surface texture. These characteristics are inherent to natural materials and are considered part of the identity and aesthetic value of the product.

These variations do not constitute defects.

By placing an order, the client acknowledges and accepts the natural variability of these materials.

4. Stone Matching (Alabaster)

Products incorporating multiple alabaster or stone elements may naturally present variations between pieces.

Although CONTAIN makes reasonable efforts to select components that are visually compatible, exact matching in tone, veining, colour or translucency cannot be guaranteed.

Differences between stone components are inherent to the geological origin of the material and should be expected.

Such variations do not constitute manufacturing defects.

5. Brass Finishes & Patinas

Products manufactured in solid brass or brass finishes may develop natural variations in tone, colour and surface appearance.

Certain finishes, including brushed, aged or blackened brass, may evolve slightly over time as part of the natural ageing process of the material. These variations are characteristic of the material and do not constitute defects.

6. Dimensional Tolerances

Due to the handcrafted nature of production, small dimensional variations may occur.

Unless otherwise specified in writing, tolerances of up to ±5 mm may apply to standard components and structural elements.

Such tolerances are considered normal within artisanal manufacturing and shall not be considered defects.

7. Payment & Production

Full payment is required to begin production. Orders will be automatically cancelled if payment is not received within 10 working days.

Clients must confirm all product specifications, including finishes, dimensions and technical details, before payment in order for the order to be considered complete. Once payment has been received and the order has entered production planning, changes may no longer be possible. Any requested changes after this point may result in revised lead times.

All bank transfer fees and financial charges must be covered by the client.

Production lead times begin once:

• Payment has been received

• All specifications and approvals have been confirmed

Production times are indicative and may vary depending on the product, finish, quantity and current production capacity.

An indication of estimated lead times by product category can be found in the current CONTAIN price list.

8. Shipping

Shipping costs are calculated based on destination, size and weight. CONTAIN ships worldwide.

Customs duties, taxes and import-related charges are not included and must be covered by the client.

For deliveries outside the European Union, shipping and transport organisation may be the responsibility of the client. In such cases, goods will be made available for collection at our facility or handed over to a carrier arranged by the client. CONTAIN will inform the client in advance if this applies to a specific order.


In these cases, risk transfers to the client upon collection or handover to the carrier.

When CONTAIN organises the shipment, risk transfers to the client upon delivery.

The client is responsible for providing complete and accurate delivery information. Any additional costs resulting from incorrect or incomplete addresses will be charged to the client.

Estimated transit times after dispatch:

Spain: 2–3 working days

Europe: 2–4 working days

Rest of the world: 3–6 working days

Transit times are estimates provided by carriers and may vary depending on destination and logistics conditions.

9. Shipping Claims

Lighting products are fragile and may occasionally suffer damage during transport. Although each order is carefully packed, in the event of shipping damage the following conditions apply:

• The original packaging must be retained

• Damage, including broken or missing parts, must be reported within 48 hours of delivery

• Photographic evidence or documentation may be required

Once verified, CONTAIN will arrange repair or replacement at no additional cost. Replacement or repaired products will be manufactured according to standard production lead times.

10. Lost Parcels

If a shipment is confirmed lost during transport, CONTAIN will investigate the case with the carrier.

Once confirmed lost, a replacement product will be produced and shipped at no additional cost. CONTAIN is not responsible for shipments lost due to incorrect or incomplete shipping information provided by the client.

11. Returns

All CONTAIN products are manufactured to order.

Returns are not accepted unless the product presents a confirmed manufacturing defect or has been damaged during shipping.

Returns due to change of mind, aesthetic preference, incorrect specifications or ordering mistakes by the client are not accepted. If a manufacturing defect or transport damage is confirmed, CONTAIN will assume the reasonable costs associated with return and replacement.

12. Cancellations

Orders may be cancelled in writing within five (5) working days after payment confirmation. After this period, cancellation will no longer be possible as production will have already started.

13. Warranty

All products include a two-year manufacturing warranty covering defects not caused by misuse, improper installation or incorrect handling.

The warranty does not cover:

• Normal wear and tear

• Light sources or bulbs

• Damage caused by unsuitable environmental conditions

• Modifications or alterations

• Improper installation or maintenance

Manufacturing defects detected after installation or during use must be reported as soon as possible within the warranty period.

14. Installation & Regulatory Compliance

Installation must be carried out by a qualified professional electrician or installer.

CONTAIN shall not be responsible for damages, malfunctions or safety issues resulting from incorrect installation, improper electrical connection, modifications to the product, or failure to follow installation guidelines.

The client is responsible for ensuring that the product complies with local electrical regulations, certification requirements and building codes in the country of installation.

15. Delivery Times & Unforeseen Circumstances

Delivery times are indicative and may be extended due to delays caused by suppliers, subcontractors, material shortages or other circumstances beyond CONTAIN’s reasonable control. Such delays shall not constitute grounds for order cancellation or compensation.

16. Retention of Title

All goods remain the property of CONTAIN until full payment has been received.

17. Limitation of Liability

CONTAIN’s liability is limited exclusively to the value of the purchased product.

CONTAIN shall not be liable for indirect, incidental or consequential damages, including but not limited to project delays, installation costs, loss of profit or loss of business resulting from the use of the product.

18. Legal Information

In accordance with Spanish consumer law (Royal Legislative Decree 1/2007), the right of withdrawal does not apply to custom-made or personalised products.

These purchase conditions are governed by Spanish law.

Any dispute shall fall under the jurisdiction of the courts of Palma de Mallorca, unless mandatory consumer protection regulations provide otherwise.
